Please read all terms & conditions before you book. Reading and accepting the Terms & Conditions is a required part of the booking process.

Acknowledgment

By booking or participating in a Retreat Program, participants acknowledge that they:

• Have read and understood these Terms and Conditions;

• Understand the nature of the retreat activities;

• Voluntarily accept associated risks;

• Agree to comply with all retreat policies and directions.

This website is operated by Ancient Paths. Throughout the site, the terms “we”, “us” and “our” refer to Ancient Paths. Ancient Paths offers this website, including all information, tools, products and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and booking with us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

Standard Booking Conditions – These Booking Conditions will come into place when you pay your non-refundable deposit.

Please read and understand the conditions of booking set out below BOOKING CONDITIONS prior to booking a trip with us as they set out your legal rights and obligations in relation to your booking.

It is assumed that you have read the itinerary relating to your trip prior to booking to ensure that you understand the type of trip you are undertaking. Other FAQ are on our website.

1. OUR CONTRACT 

Your booking contract is with Ancient Paths (ABN 82906348138) By booking a trip with us you have agreed to be bound by the terms and conditions set out in:

• The information provided in the specific trip itinerary – all of which constitutes the entire agreement between You and Us. ​

Your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice. In these Booking Conditions references to “you”, “your”, and “the traveller” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred, both during the 

retreat, in the lead up to the retreat (subsequent to the non-refundable deposit being paid), and on any pre-retreat and or post-retreat extensions. 

 

2. PRIVACY & CONFIDENTIALITY POLICY

Any personal information that we collect about you will be handled in accordance with our Privacy Policy. You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy. To participate in any scheduled retreat inclusive of Meditation Practice your agreement to sign our Confidentiality agreement is essential for participation prior to undertaking booked tour. 

 

3. DEPOSIT REQUIREMENT 

You are required to pay a non-refundable deposit for your booking to be confirmed. Once this is paid, you are considered bound by these conditions.

You are required to pay a non-refundable deposit of AUD$1,500 per person per retreat.   If your deposit is made within 4 months of the start of retreat date then full amount is payable at the time of booking. 

​

4. ACCEPTANCE OF BOOKING & FINAL PAYMENTS

If we accept your booking, we will issue you with a booking confirmation invoice/receipt. A contract will exist between you and us from the date we issue the confirmation invoice. Or if you book within 4 months of retreat start date the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. 

• Payment Schedule – 4 months prior to retreat start date 100% of payment must be received.  If your final payment is not received by 4 months prior to retreat start date, Ancient Paths may treat your booking as cancelled and any cancellation charges outlined at clause 7 (CANCELLATION BY YOU) will apply. 

  

5. PRICES AND SURCHARGES

Our retreat prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our tour prices may vary at any time in accordance with demand, market conditions, availability and (sustainability development fees for Bhutan). 
 

The most up-to-date pricing is available on our website. Prices are based on currency exchange rates as and when we can update them; please note that prices may vary depending on which currency the booking is made. We endeavour to ensure that all pricing and all other information on our website is accurate. However, it is as always, a possibility that despite all efforts there may be at times errors or some others details displayed being incorrect. We reserve the right to amend advertised prices at any time prior to us sending your booking confirmation invoice. 
 

We reserve the right to impose surcharges up to 60 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. Please note that a surcharge may be applied to a purchase made by credit card.

6. YOUR INORMATION DETAILS

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip fee. Necessary details vary by retreat; they include but are not limited to full legal name as per passport, date of birth, nationality, passport number, passport issue and expiry date (passport must be valid for at least 6 months prior to requiring renewal) certificate of travel insurance, and any pre-existing medical/health conditions you have which may affect your ability to complete your travel arrangements. 7 CANCELLATION BY YOU

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation from you that you wish to cancel. If you cancel a trip:

​

a) 121 days (4 months) or more prior to retreat start date, we will hold your deposit amount;

b) 30-120 days (1-4 months) prior to retreat start date, we charge a cancellation fee of 50% of the total booking cost;

c) 29 days prior (less than 1 month) to retreat start date, we charge a cancellation fee of 100% of the total booking cost. 

​

As part of your attendance on any booked retreat, you are required to have your own comprehensive travel insurance that includes cancellation insurance as part of your insurance policy. If you leave a trip or make unscheduled arrangements outside of the set itinerary for any reason after the retreat has commenced, we are not obligated to make any refunds for unused services. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation terms are in addition to fees which may be levied by accommodation providers, travel agents, or other third-party tour and transport operator fees. Please refer to clause 21 (Liability), which provides more information about your rights under Australian Consumer Law which may apply to your cancellation.

Please note: Ancient Paths is a sole trader retreat host business and operates on small margins; we endeavour to provide the best service at a great price and our cancellation policies are based on the timing that we must make payments to contractors and other suppliers.

​

8. CANCELLATION BY US

Our retreats are guaranteed to depart once they have five fully paid customers unless minimum group size specifically states otherwise, and subject to reasonable itinerary changes as described in these Booking Conditions. 

In the event that we cancel your retreat, you can transfer amounts paid to an alternate departure date or receive a refund, unless your trip is cancelled due to a Force Majeure Event (as defined below in cause 9).

In the unlikely case that less than five people are booked on a retreat, all possible arrangements will be made to conduct the retreat as either a private retreat, or as an amended group retreat. Provisions will be discussed at the time with all the relevant participants.

 

9. CANCELLATION DUE TO FORCE MEJEURE

In addition to the cancellation rights set out above, a trip may be cancelled due to a Force Majeure Event occurring at your retreat destination or in transit to your destination or its immediate vicinity and significantly affecting the performance of the retreat or significantly affecting the transport arrangements to the destination.

In these circumstances, we will offer you:

​

1. Either: 

a) a 100% credit of monies paid for your retreat; or

b) a refund minus unrecoverable costs. Unrecoverable costs include, but are not limited to payments made to third-party operators-providers that are non-recoverable by Ancient Paths, government-imposed fees, administrative costs.

​

If the cancellation due to Force Majeure Event occurs after your retreat has commenced, Ancient Paths will offer you: 

​

2. Either:

a) 100% credit for the days that remain on your retreat; or

b) refund minus unrecoverable costs of the days that remain on your trip. Unrecoverable costs include, but are not limited to payments made to third-party operators-providers that are non-recoverable by Ancient Paths, government-imposed fees, administrative costs.

 

A “Force Majeure Event” means any event or circumstance beyond the reasonable control of parties, whether or not foreseeable, which would make it  dangerous or not viable for a retreat to commence or continue and includes but not limited to acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union disputes; earthquake; epidemic; pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order proclamation, regulation, ordinance, demand, requisition, or requirement or any other act of any government authority, government boarder  closures, beyond the reasonable control of parties. 

​

In the event of any cancellation, there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights or bookings outside of retreat schedule.

10. CREDIT

There may be circumstances in which we issue you with credit. For instances, we may offer you the choice of a credit voucher instead of a cash refund when you are entitled to a full or partial refund. Unless specified otherwise in writing, any credit issued under these Booking Conditions:

​

• Credit is available for a three-year period. 

• May be applied towards any other available retreat offered by us;

• Is not transferable to another person or redeemable for cash; and

• May not be used to book flights or insurance as they have their own booking conditions.

 

11. BOOKING AMENDMENTS

Transfers to a third party or an alternative retreat are only permitted when operationally possible and, in the case of transferring to a third party, where the transferee meets all the requirements in relation to the retreat. Certain fees may apply. 

No amendments are permitted to your booking within 120 days of departure. 

 

12. INCLUSIONS

The land price of your retreat includes, as described in the relevant itinerary;

• All accommodation

• All transport within retreat country as per relevant itinerary

• Sightseeing, entry to all monuments; and all meals

• Meditation guided practice

• The services of your retreat host 

• Airport transfers within a 2-day period of designated retreat dates. 

13. EXCLUSIONS

The land price of your retreat does not include:

• International flights

• Internal flights unless specified

• Taxes and excess baggage charges

• Meals other than those specified in the relevant itinerary

• Alcohol.

• Visa (unless specified) and passport fees

• Travel insurance

• Optional activities and all personal expenses

 

14. AGE, HEALTH REQUIRMENTS, GROUP SIZE, ROOM GUARATEES

 

MINIMUN AGE: For the majority of our trips, the minimum age is 18 at the time of travel, unless otherwise specified.

 

MAXIMUM AGE: For the majority of our retreats, we have no upper age limit. It is your responsibility to ensure that you obtain proper detailed medical advice at least 4 months prior to travel for the latest health requirements and recommendations for your destination.

 

Please refer to the itinerary that relates to your trip for information.

 

HEALTH: Participants are responsible for assessing their own physical, emotional, and psychological suitability for participation. Participants must disclose any relevant medical or psychological conditions, disabilities, allergies, injuries, medications, or support requirements that may affect participation. Retreat programs may include:

​

• Meditation and mindfulness practices;

• Breathwork and guided visualisation;

• Yoga or movement-based practices;

• Hiking or physical activity;

• Emotional processing;

• Emotional reflection;

• Silence or periods of introspection;

• Cultural immersion experiences;

• International travel and unfamiliar environments. 
   

These activities may be physically or emotionally demanding. Participation is voluntary at all times. We do not provide medical or psychological treatment unless explicitly stated. Participants acknowledge that retreat experiences are not a substitute for medical care, psychiatric care, crisis support, or psychological treatment. We may require medical clearance from a treating practitioner before participation. We reserve the right to remove a participant from activities where safety, wellbeing, or conduct concerns arise. Participants agree to disclose any relevant medical, psychiatric, psychological, or physical conditions that may reasonably impact their participation, safety, or wellbeing, including but not limited to:
 

• Current or historical mental health conditions 

• Recent psychological distress or crisis presentations 

• Physical injuries or medical conditions 

• Medications that may affect participation 

• Allergies or dietary requirements 

• Mobility or accessibility needs 
   

We may request additional information or medical clearance from a treating practitioner where reasonably necessary to assess suitability for participation. Participants understand that such experiences may evoke emotional discomfort, fatigue, stress responses, or psychological reactions. Unless explicitly stated in writing, participation in the retreat does not establish a therapeutic, clinical, treatment relationship between the participant and the facilitators, guides, or staff. Retreat programs are intended for educational, wellbeing, cultural, and personal development purposes only and are not a substitute for:
 

• Medical treatment 

• Psychological therapy 

• Psychiatric care 

• Crisis intervention 

• Emergency mental health support 
   

Participants are encouraged to continue any existing treatment plans and consult their treating healthcare professionals regarding suitability for participation. We reserve the right to determine whether participation is appropriate where concerns arise regarding a participant’s health, safety, wellbeing, or capacity to engage safely in retreat activities. We may refuse, limit, or discontinue participation where:
 

• A participant presents a risk to themselves or others; 

• Required medical information has not been disclosed; 

• The participant’s condition may be adversely affected by retreat participation; or 

• Adequate support cannot reasonably be provided within the retreat setting. 
   

Where appropriate, we may recommend that the participant seek medical or psychological advice prior to participation. Participants remain solely responsible for:
 

• Managing their own medications; 

• Attending to ongoing healthcare needs; 

• Bringing sufficient medication and prescriptions for international travel; and 

• Maintaining contact with treating practitioners where necessary. 
   

We do not administer medication or provide ongoing clinical supervision unless specifically agreed in writing.

In the event of a medical or psychological emergency, participants authorise Ancient Paths to seek appropriate emergency assistance, including medical treatment, hospitalisation, evacuation, or contact with emergency contacts where reasonably necessary. Any costs associated with emergency care, transport, evacuation, accommodation changes, or treatment remain the responsibility of the participant. Participants acknowledge that personal growth experiences may involve emotional vulnerability and psychological discomfort. To the extent permitted by law, participants voluntarily assume responsibility for risks associated with emotional processing, psychological reactions, and participation in reflective or experiential activities. Nothing in this clause excludes rights or guarantees that cannot lawfully be excluded under Australian Consumer Law.

 

GROUP SIZE: The minimum group size for retreats run by Ancient Paths is five people. Generally, groups are preferred between 8-12, on occasions we will run larger retreats.   

 

ROOM GUARATEES: We will make all endeavours to ensure that attendees paying the base-fee for a retreat are provided with twin-share accommodation. Solo attendees will have to travel in solo rooms and pay the solo supplement. 

 

15. ADDITIONAL TERMS

Due to the nature of our retreats, in addition to these BOOKING CODITIONS, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your retreat.

To the extent there are any inconsistencies between the terms of these BOOKING CONDITIONS and the supplemental waiver, the terms of these BOOKING CONDITIONS shall prevail and supersede any supplemental waiver. We reserve the right to deny participation to you if you have not signed a waiver.

Photography and Media Consent: We may photograph or record retreat activities for promotional purposes, that does not identify persons.

 

16. PASSPORT & VISA

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country region you visit on your retreat (unless otherwise stated). This includes a valid passport and all travel documents required by us and /or the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel with us as set out on your itinerary. You accept full responsibility for obtaining all such documents visas and permits prior to the start of the retreats (unless otherwise specified), And you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in the possession of proper travel documentation.

17. TRAVEL INSURANCE

Travel insurance is mandatory for all our travellers and must be taken out at the time of your booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of AUD$200,000 for each category of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide a copy of your travel insurance policy 120 days from the commencement of your retreat, and the insurance company’s 24-hour emergency contact number; you will not be eligible to join the retreat without these details. If you have travel insurance connected to your credit card or bank account, please ensure you have details of the participating insurer, that is a copy of the insurance policy – number and emergency contact number (Bank name and credit card details will not suffice). Failure to provide proof of insurance within the specified time frame may result in cancellation of your booking without refund.

18. CHANGE OF ITINERARY

You acknowledge and appreciate that the nature of this retreat travel requires considerable flexibility and you should allow for alternatives. The Itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, hotels, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

​

While we endeavour to operate all retreats as described we reserve the right to change the trip itinerary. As we are a small entity, we will communicate any changes as we become aware of them should they arise. 

​

PRIOR TO DEPARTURE: If we make a significant change we will inform you as soon as practically possible if there is sufficient time before departure. The definition of a significant change is deemed to be a change affecting at least one day in five of the itineraries. When a significant change is made you may choose between accepting the change and paying any additional costs associated with the change (should they occur) or obtaining a refund of the land portion of the retreat only, or accepting an alternate retreat offered. 

AFTER DEPARTURE: We reserve the right to change an itinerary after departure due to local circumstances or a Force Majeure Event. In such emergency circumstances, the additional cost of the necessary itinerary alterations will be covered by you. 

Please note: we are not responsible for any incidental expenses that may be incurred as a result of any changes in itineraries including but not limited to visa, vaccinations, or non-refundable or non-changeable flights. 

 

19. AUTHORITY ON RETREAT

Our retreats are hosted by Julie Trista, founder of Ancient Paths. Decisions made by Julie Trista are final concerning safety, well-being, and logistics of the retreat. However, any concerns should be raised with Ancient Paths post-retreat, if you feel decisions were unfair or unreasonable. If you fail to comply with a decision made by Julie Trista, interfere with the well-being of the group or our ability to run the retreat as planned, you may be directed to leave the retreat immediately, with no right of refund. We may also elect not to carry you on any future retreats booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree that you have read our Travel Guidelines.

20. ACCEPTANCE OF RISK

You acknowledge that the nature of the retreat may be adventurous and participation involves a degree of personal risk.

We will take all reasonable steps to ensure your safety and may require you to follow additional safety procedures on your retreat. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to inform yourself of all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made with consideration of this information and you accept that you are aware of the personal risks associated upon such travel. 

While we take all reasonable steps to ensure safety, you acknowledge that participation involves inherent risks, and we are not liable for risks outside our reasonable control.

21. LIABILITY AND SERVICE GUARANTEE

Our service, which include our retreat (“Service”), may come with guarantees that cannot be excluded under consumer protection laws, including but not limited to:

​

• Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)),

• UK Consumer Rights Act 2015

• New Zealand Consumer Guarantees Act 1993

• EU Consumer Rights Directive2011/83/EU 

• Relevant federal and state laws in the United States, including the Federal Trade Commission Act
   

These Laws provide rights which cannot be excluded, restricted, or modified, and this clause is subject to those protections.  

 

21.1. MAXIMUM EXCLUSION OF LIABILITY

To the fullest extent permitted by applicable law in your country of residence, we exclude all liability whatsoever (whether in contract, tort, statute, or otherwise) for any direct or indirect loss, damage, injury, delay, or inconvenience that you may suffer in connection with your participation in a retreat, except where such liability arises from our fraud, gross negligence, or wilful misconduct.

21.2. IMITATION OF LIABILITY

Where any consumer guarantee, warranty, or other right is implied by law and cannot be excluded (such as under the Australian Consumer Law, UK Consumer Rights Act, NZ Consumer Guarantees Act, or similar provisions in EU/US Law), our liability is limited, where permitted, to either:

• The re-supply of the relevant service, or

• The payment of the cost of re-supplying that service.

 

21.3. INDEMNITY

You agree to indemnify and hold harmless Ancient Paths, its officers, directors, employees, contractors, and agents from all claims, losses, or damages (including legal costs) arising directly or indirectly from your use of the Service, or breach of these Booking Conditions or any applicable Law in your home jurisdiction or while on retreat.

21.4. THIRD-PARTY SUPPLIERS 

We work with third-party suppliers (such as hotels, transport providers, activity operators) to deliver services. These third parties may have their own terms and conditions, and you agree to be bound by them. While we make reasonable efforts to ensure their reliability, we are not liable for their acts or omissions.

​

21.5. JURISDICTION-SPECIFIC NOTE

Your consumer protection rights are governed by the applicable consumer laws of your country of residence. If you reside in the UK, EU, New Zealand, or the USA, additional consumer rights may apply, and these Terms are intended to operate in harmony with those protections. If any provision in these Booking Conditions conflicts with a consumer law that applies in your jurisdiction, that consumer law will take precedence to the extent of the inconsistency.

22. OPTINAL ACTIVITITES

Optional Activities not included in the retreat price do not form part of the retreat or this contract. You accept that any assistance, recommendations or advice given by your host or local representative in arranging optional activities (including before or after a retreat) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

23. CLAIM & COMPLAINTS

If you have a complaint about your retreat please inform your host or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been resolved through theses means then any further complaint should be put in writing to us within 30 days of the end of the retreat at info@ancientpaths.com.au

24. SEVERABILITY

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation by law or as being against public policy or for any reason then, such term or condition shall be deemed to be severed from this contact or amended accordingly only to such extent necessary to allow all remaining terms and conditions to endure and continue as binding. 
 

25. APPLICABLE LAW

The Laws of NSW, Australia govern these Booking Conditions to the fullest extent allowable. Nothing in these Booking Conditions, including this clause 25, affects your rights as a consumer to rely on any applicable local laws. These Booking Conditions and any separate agreement where-by we provide you services shall be governed by and constructed in accordance with the laws of 12/39 Market Street Wollongong, NSW 2500 Australia.

26. ANCIENT PATHS

Ancient Paths is able to help organise additional days, either pre- or post-retreat, at the first or final hotel destination, if you wish to start early, or stay longer, this will incur additional costs, these costs will be indicated individually on the relevant itinerary for that retreat.   

​

In the case that you wish to either extend your stay longer, or start earlier, in a way that requires hotel changes, or travel further afield, Ancient Paths can provide for this in accordance with the service provided by Ancient Paths. Please find the relevant details for this at the F&Qs.

27. BOOKING ENITITY

You will be booking through Julie Trista (ABN 82906348138), trading as Ancient Paths. 

​

28. PROMOTIONAL TERMS

From time to time, we may run promotions and special offers (Promotions) on our website which are subject to both these Booking Conditions and any additional promotion-specific terms which are incorporated into these Booking Conditions by reference. You should ensure that you understand the specific conditions that apply to each promotion.

​

Promotions are available for a limited time, as defined on our website. We reserve the right to cancel or change any Promotion at any time in our discretion. By purchasing a retreat on a promotional basis, you agree and accept the terms that apply to the applicable Promotion. In the event of any inconsistencies between these Booking Conditions and the Promotional terms, the Promotional terms apply to your booking.

29. PROHIBITED USES

You may not use our products or services for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction, including but not limited to copyright laws. A Breach or violation of any of the Terms and Booking Conditions will result in an immediate termination of your service and or booking.
